California elder law attorney here. I am just going to say that all of this seems like a bad idea, I'm sorry to say. I've seen scenarios like this a hundred times and I've literally never seen it turn out well. Also, who told you 4-6 months for a probate? A year is the average in most counties. I suppose if you're in a really small county and you have a VERY efficient attorney, it could be done in 6 months. How are you going to pay that attorney's fees? If you're doing it yourself, I think 4-6 months is a pipe dream. Further, all the siblings are going to just take title together? I suppose everyone is going to agree, all the time, about how to manage the property? Who will pay for its upkeep? Taxes? No one is going to have creditor or money trouble that will put your now joint property at risk? Speaking of taxes: Prop 19. If you intend to rent the house out, you won't get the parent-child exclusion, which means property taxes are going to go through the roof when mom dies. What did the elder law attorney say about saving the house? There is still a way to do a trust. It would be through a conservatorship but it could in theory be done through emergency orders. It would cost a few grand but that's one way to spend down mom's money toward MC eligibility. There's just so much here. A good elder law attorney should be able to advise you on all of this, including the viability of the refi plan. Not just tell you what the POA does and doesn't let you do.
