I'm talking about the criminal prosecution that OP says is happening. California law requires victim restitution for actual damages if there is a criminal conviction. Things like therapy costs are also usually eligible, and I would probably need some visits with a therapist if someone shot into my bed while I was in it. I was not talking about the civil torts because someone already pointed out why that is not a viable route to compensation (also I am a criminal defense attorney and have cheerfully forgotten every minute of my torts classes).
