Failed Subrogation

Failed Subrogation Not sure what to do here. In May 2025, my husband purchased gas from a Marathon fuel station and in a couple of days, when trying to head to work, his car wouldn’t start. We eventually took it our dealership and they found water in the fuel line. My husband spoke to someone at the gas station and they admitted to similar problems with other customers so we submitted a claim to Progressive and paid our $1,000 deductible. The required repairs were made and Progressive has been attempting to recover our deductive since that time (it’s now October), but Marathon is saying we have made a false claim even though their employee admitted it wasn’t. Progressive notified us today that all their efforts have failed and that if our state allows, we can pursue recovery on our own. What the actual hell? How is this fair? And what do we do now?
