Home insurance policy denied on a technicality.
Home insurance policy denied on a technicality.
Greeting.
I had a house fire last week. I have, or at least thought I had, home owners insurance.
I purchased the home from my mother in law in 2019, and she lived with us up until late last year in 2023.
For some reason, the insurance policy was left in her name despite everything else being taken over by me. I am the only one on the mortgage, and only my spouse and I are in the title. I had thought that the insurance was under me as well, being as it's paid by my lender's escrow account.
The insurance company has denied the entirety of the claim. I have submitted proof that I was making the payments since the inception of this loan. In fact, I also submitted proof that it was me paying the entirety of the payments to my mother in laws loan for it's entire lifetime. (The adjuster asked for this)
I haven't yet received the written notice of being dropped, but was told by my adjuster this afternoon. I expect the written notice by Monday.
I already had an appointment for a consult with a lawyer on Monday, even before they officially denied me.
I contacted my lender. They don't want to pursue anything on their end.
Is there anything I can do? This is in northern Alabama, Madison County.
