Mortgage company put my home in foreclosure - need advice, California We refinanced our home 2 years ago (ish). After a few payments it was sold to \*New\* Mortgage Company. I had difficulty getting the new loan number and address to send my payments to, but I eventually prevailed and managed to put our mortgage on automatic bill pay. We pay more than our payment each month to pay down principal (about $400 per month extra). I have verified that these payments have been made each month, on-time on both the mortgage statements and my checking account. Fast forward to June 2022. They asked for my homeowners insurance, which is fine and they called my agent while I was on the phone and my agent sent them the information. I received a letter from Mortgage company saying that they received my insurance information and were satisfied and would remove any charges (if there were any) pertaining to my account. Issue solved, right? It’s in writing…..ll They sent me a certified letter, which I picked up from the PO and it said my home is 2 months in arrears on payments and that I owe them $8k and some change. WTF? So I called them to find out what is going on and it’s for fire insurance. They never reversed any of the charges. Their excuse? My old \*Company redacted\* policy ended in April and my new policy started in March. There was a lapse of 1 month of insurance. That’s not what my paperwork says (which they have copies of - and verified as much). I resent both years of my policy, same policy number, same company. And everyone knows that you can’t randomly decide not to have insurance coverage for 1 random month and still keep the same policy number. Insurance just doesn’t work that way. My policy has always been paid on-time and was/is in good standing. So now they’re saying it could take them another 2 weeks to look at my paperwork and rectify this situation (which they didn’t do last time). Meanwhile I’m getting mountains of foreclosure paperwork from them. Far more than is necessary. And my credit score has been trashed. I have zero faith that they will fix this and it’s our home (Read: not funny). Can someone advise me on what I should do to protect our home? I do have access to an excellent real estate attorney. Should I call him tomorrow? Is there a state agency I can complain to? They will just continue the foreclosure process at this time, I’m pretty sure.
