Semi on semi truck crash, can I be sued for selling my dashcam footage?
Location: Deadman Pass, Oregon
Im a long haul trucker and about a year ago I was involved in an accident when another trucker jackknifed on icy roads. I was deemed not at fault and I just got the news that insurance has finally settled. I’ve posted dashcam footage of wildfires and stuff on Reddit before and I’ve had people ask about buying the footage or using it in YouTube videos. My dashcam footage of the crash looks like something straight out of an accident attorney’s ad, so I figured I could probably recoup some of the losses by selling the footage.
My worry is if the other driver sees his truck in a tv add or a billboard, he could try to sue me. I don’t have any way to contact him to ask permission. He isn’t very identifiable in the video, his company logo is too small and pixelated to read, but his trailer’s license plate is legible for a couple frames just before impact.
If he learns that I’ve sold the footage, can he sue me? I’d be willing to risk it if he can sue for half of the profits, but I don’t want to get sued for all or more than what I make.
