Good afternoon,
So here is the brief details:
*My (vacant) home has been for sale for the last ~month (in contract for sale but I don't believe that is relevant to this issue).
*Last week the house was broken into and items inside were vandalized and/or stolen, including items provided by the staging company.
*The police were called and a police report filed (plenty of evidence of forced entry, all documented).
*My insurance company was contacted and a claim started for the property damage and personal-property stolen.
*The staging company sent me an itemized list of their missing items and a bill for ~$3,000.
*I started a second claim with my insurance for liability regarding the staged items.
*Today I was informed that since the items provided by the staging company are considered "rental" my liability insurance would not apply (only fire, flooding and smoke are covered per the insurance agent I spoke with)
*I have been told (not by a lawyer or legal expert) that CA has a specific exemption for rented items that are stolen when there is evidence of a break-in. But; as far as I can find, that is only for "rent-to-own" items and I am not sure this qualifies.
So am I liable for the full ~$3,000 the staging company is claiming? Do I have any options?
