[Landlord - US IN] Tenant put up above ground pool - what is my liability risk with just their renter’s insurance coverage?
[Landlord - US IN] Tenant put up above ground pool - what is my liability risk with just their renter’s insurance coverage?
Hello!
I recently learned my tenant put up a 10’ x 13’ x 4’ pool in the fenced in back yard without asking me prior. I did reach out to my landlord insurance and they stated what’s in the attached screenshot. I was really hoping that it would have just been a matter of a raised premium and I would have my tenant cover the difference or something but alas, it seems like that’s not possible.
Now my tenant did learn that their renters insurance has liability coverage or $100,000 to my $300,000. My question is, should anything happen to them or their guests, would their coverage be enough to take care of things or would I be completely legally/financially vulnerable?
The lease does not specifically bar pools but there is a clause stating the tenant is responsible for “Taking affirmative action to insure that nothing exists which might place the owner in violation of applicable building, housing and health codes” and “Assuring that property belonging to the owner is safeguarded against damage, destruction, loss, removal, or theft.” Not sure if that’s helpful but wanted to include it.
Thank you for any helpful advice!
