California: Fired on Day 1 of New Job due to Massive Heart Attack-- Asking for a friend A buddy of mine and I are in sales of IT products/services. Companies give us quotas of $2M-$8M / year and if we hit that, we get half of our compensation from commission. Our performance determines our income but also whether or not we get to keep the job. ​ So, a couple weeks ago, my friend accepted an offer from a smallish IT company to start selling for them in a particular territory in the NE/Mid Atlantic. He resided in Maryland and mostly worked from home. Again, the HQ of this company is in California. ​ Well, he suffered a massive heart attack on his first day of work. Will spare you the details but the company who just hired him, immediately fired him presumably for having the heart attack or so that they wouldn't have to pay for his health insurance to pay for the health care he needed (which exceeded $300K--another reason many of you should destress and go for a walk today perhaps). ​ So, my friend is in recovery and he isn't thinking about stuff like this. I told him I would look into it just to see if there was anything there from a legal standpoint. Does the company that hired/fired him have any liability here? I would presume that the company followed the law and has attorneys who advise them. Sure, at a minimum it would seem they made a move that should likely bring bad karma but what about the legal front? ​ I'm not emotionally tied to either outcome--whether he has cause of action or not. I just want my friend to continue to heal up and move on with his life. He was a smoker--if that matters to anyone. My plan was to call an employment attorney in California and Maryland and get a free consultation but figured this might be a useful topic to gain insights as well. Really appreciate any pointers or explanations of potentially applicable legal concepts. Thank-you!
