Never received insurance non-renewal notice and got in an accident, Colorado
I moved to Colorado in 2020 and In early 2022 I updated my policy to include my fiancé as an approved driver, as well as updated my home address. I received an email saying my insurance policy is all set, automatic payments were enabled and I’m good to go.
I got in an accident where I was designated as at-fault. When I went to get my electronic insurance card it said it was expired. I called progressive and they said that their underwriting team flagged my policy (after the changes above were approved) as needing to be updated since it originated out of state. I never received any email about this and they said they mailed a notice of no-renewal which I never received.
The other drivers insurance company has now entered subrogation for the damages and I could have my license suspended unless I settle with them.
Colorado section 10-4-604 states that they need to give me 30 days advance notice of no renewal legally. If I never received the letter they claim they sent does that qualify as 30 days notice? Do they have any responsibility of ensuring I receive the notice? I signed up for all electronic documents and can’t believe I never received a single email saying ‘hey your insurance is going to lapse’. I also lease my car and received no notice from the dealership which I was informed they do receive a report on all their leased cars current insurance and I am legally required to have insurance on the lease, so also surprised I never received notice from them.
At the end of the day it’s on me to keep tabs on my insurance (I now have new insurance and checking periodically) and can’t believe i was driving around unknowingly without insurance and am very thankful the accident was very minor and there were no injuries.
Do I have any recourse?
